Terms of Service

1. Acceptance of Terms

By accessing or using the MySwimApp website (myswimapp.com) or the MySwimApp iOS app (together, “the Service”), operated by Foxtide LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MySwimApp aggregates publicly available competitive swimming data — including meet results, swim times, team rosters, and motivational time standards — from meet result files published by Local Swimming Committees (LSCs) and meet hosts. We provide tools such as swimmer profiles, time standards lookup, a cuts checker, split calculator, course conversions, live meet tracking, and a college outlook.

3. Not Affiliated with USA Swimming

MySwimApp is an independent service. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to USA Swimming, Inc., any Local Swimming Committee, or any other governing body. “USA Swimming” is a trademark of USA Swimming, Inc., used here solely to identify publicly available competitive swimming data and published time standards.

4. Data Accuracy Disclaimer

Swim times, rankings, standards, college projections, and other data displayed on MySwimApp are aggregated from publicly available sources and provided “as is” and “as available” without warranty of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, timeliness, or fitness for a particular purpose.

You should not rely solely on MySwimApp for meet entry decisions, qualifying time verification, recruiting decisions, or any other purpose where incorrect data could cause harm. College outlook ranges are estimates for guidance only and are not a recruiting, eligibility, or placement service. Always verify cut times, qualifying standards, and results with your coach, meet host, or LSC.

5. Accounts

The app offers an optional account using Sign in with Apple. If you create an account, you are responsible for maintaining the security of your sign-in and for all activity under your account. You must be at least 16 years old to create an account. You may delete your account at any time from within the app (Settings → Delete account) or by contacting us. We reserve the right to suspend or terminate accounts that violate these terms.

6. MySwimApp Plus Subscription

MySwimApp Plus is an optional auto-renewable subscription that unlocks additional features. Subscriptions are offered through the Apple App Store, and the current options, prices, and any free trial are shown in the app before you purchase.

• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Purchases, billing, and refund requests are handled by Apple under Apple's Media Services terms. We do not process or store your payment card details.

The core MySwimApp experience — following swimmers, live meet tracking, cuts, PRs, and results — remains free to use.

7. Intellectual Property

The MySwimApp name, logo, website and app design, compiled database, and original content are the property of Foxtide LLC and are protected by copyright and other intellectual property laws. Individual swim times and meet results are factual data and are not claimed as our intellectual property.

8. Prohibited Uses

You agree not to:

• Scrape, crawl, or use automated tools to bulk-download data from the Service
• Reproduce, redistribute, or create derivative works from the Service's compiled database without our written permission
• Use the Service in any way that suggests affiliation with or endorsement by Foxtide LLC
• Interfere with or disrupt the Service or its underlying infrastructure
• Use the Service for any unlawful purpose or in violation of any applicable law

9. Limitation of Liability

To the fullest extent permitted by law, Foxtide LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Foxtide LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these terms.

11. Data Removal Requests

If you are a swimmer or parent/guardian and would like your data removed from MySwimApp, please contact us at support@myswimapp.com. We will process removal requests within 30 days. Removal from MySwimApp does not affect data held by other sources such as LSC websites or meet hosts.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in California.

13. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
